39 YEAR OLD ELECTRICIAN CHARGED FOR ‘MALICIOUS COMMUNICATION:’ Will Barbados Gov’t Ban Twitter & Facebook next?

First they came for the Communists
And I did not speak out
Because I was not a Communist
Then they came for the Socialists
And I did not speak out
Because I was not a Socialist
Then they came for Trade Unionists
And I did not speak out
Because I was not a trade unionist
Then they came for the Jews
And I did not speak out
Because I was not a Jew
Then they came for me
And there was no one left
To speak out for me – Martin Niemoller

  • (May 2014) “The threats against Barbadian Journalism have only just started; it will get more strenuous as the DLP try to hold on for a third term and all of their beneficiaries seek to rally defences against real or imagined threats

What did an electrician from the Bridgetown Port say that was so horrible it warranted Police action? Here is the RBPF communiqué;-

Police have formally charged Omar Shawn Watson, 39 years of Maxwell, Christ Church, for the offence of Malicious Communication.

Watson is expected to appear at the District A Magistrates Court on 27th November 2014.

Sometime in mid November 2014, a message appeared on social media which was menacing in character and caused Michael Lashley, MP annoyance, distress and anxiety. Investigations led to the arrest of Watson.

The RBPF have noticed surfacing from time to time the use of the social media to present malicious communications which at times can be very damaging to persons’ reputations. We are warning persons to desist from this type of behaviour which constitutes a criminal offence and once reported there will be an investigation.

  • David Welch – Insp.
    Public Relations Officer

(CLICK FOR BIGGER) When election time was looming in January 2013, I composed this cartoon which compared the current regime to WW2 rulers when they denied permission for a protest rally – am I speaking my mind or being a menace?

Not sure if Welch is ASP (Ag) or Inspector, I guess only Adriel knows for sure (better watch what I say to the AG when I see him Friday in Wildey, he may have jackbooted SS waiting) – but don’t get mad at Insp. Welch, like Adolf Eichmann he was only following orders – what should be of concern, is what exactly is “malicious communication“?

14. Where a person uses a computer to send a message, letter,
electronic communication or article of any description that
(a) is indecent or obscene;
(b) is or constitutes a threat; or
(c) is menacing in character,
and he intends to cause or is reckless as to whether he causes
annoyance, inconvenience, distress or anxiety to the recipient
or to any other person to whom he intends it or its contents to be communicated, he is guilty of an offence and is liable on summary
conviction to a fine of $10 000 or to imprisonment for a term of 12 months or to both.

  • Computer Misuse Act

Isn’t indecency or obscenity a subjective matter? What is a threat or being menacing?Assessment of Government’s performance? Remarking on Ministerial policy? Is any phrase which is not flattering of the Freundel Stuart regime to be construed of as High Treason? Do Bajans need to buy Swastika patches or Hammer & Sickle badges so they can do business safely? Does belief matter over how one performs their job?

(CLICK FOR BIGGER) Did Omar Watson say anything like what was done here? Should I demand Cavil Best go to jail? "...constitutes a threat..." as per Section 14 of Computer Misuse Act, this a DLP supporter but I get threats from both sides, so there's more!

Even before the time it was made known on Fri. 13 Dec. 2013 from Finance Minister Sinckler that the public sector (which this current regime pledged would have sacrosanct employment 11 months prior, including an Election video on Youtube with an old woman scared of paying Bus Fare under Owen) would have to shed jobs, there has been a series of unfortunate events which involve Barbadian media one way or another…

THREAT#4

If this is not ‘…menacing in character…’ then I don’t know what is? This is a sobriquet of “Bajan Bloggs,” but some say his real name name is Elvis Barker and is known as “Gold Teeth

Twice the Nation has faced the courts in a period less than a calendar year – once concerning an image of children at a school purported to be engaged in underage sex and the other time was for a July article where remarks struck from Parliament were relayed in the print edition of the Nation yet the periodical did not see a subpoena until November 2013 almost one month before public sector job cuts were announced.

Curtis Rogers Death Threat 28-08-2011

(CLICK FOR BIGGER) This was at the height of the Mia-Owen schism of the BLP 3 years ago, this supporter by name of Curtis Rogers was angered when I compared Arthur to the Wizard of Oz and felt a final solution was best…

Why are these attacks now appearing? There are certain Barbadians who may feel these warnings are to ensure a third term for the current administration, while others may wonder if it is a preemptive strike against any suggested “Eager Eleven” who may now want to rise up as their pensions would be assured by February next year, thus preventing what happened with the Rebel Five of 1994 against then Erskine Sandiford over the 8% Pay Cut (the quintet almost lost their pensions since it was not quite 3 years into their second term, and it required Owen Arthur‘s intervention for the guys to receive all emoluments)…

In January 2013 when elections were really due, I decided to compose this Meme - am I (as Kid Site may imply) too Malicious and Dangerous?

So there are those who feel these prods against Freedom of Expression are to guarantee nothing untoward develops before this term reaches its supposedly logical conclusion by 30th January 2018?

Voters And MP

(CLICK FOR BIGGER) The fact is, Bajans need to wake up and realise our own true power – these idiots are only there for 5 years at a time! Wake Up!!!

Barbadian media, bloggers, users of Twitter, Facebook and/or Instagram must present a United front in order for not only the Freundel Stuart regime, but our Police and/or Defence Force to understand, while there may be 30 MP‘s and approximately 1,500 constables and however many soldiers – there are 270,000 Barbadians who are getting more and more annoyed rather than disappointed with how this country’s affairs seem to be handled, if at all…

If Bajans turn from disappointment to anger, then what will be next? Only Clement Payne or Israel Lovell or even Bussa could truly answer such a question if they were still alive in such a day and age where speaking your mind can earn handcuffs!
