Barbadian Race Horse’s Sandy Lane Gold Cup Disqualification 3 years ago Overturned by Barbados High Court

Barbados Justice Elneth Kentish, Judge of the High Court, very recently upheld Mr Eugene Melnyk‘s challenge to the decision of the Barbados Turf Club, made on the 6th January 2005 whereby the Turf Club disqualified his horse KATHIR as the Winner of the Sandy Lane Gold Cup which was run on the 6th March 2004.

The effect of this decision is that KATHIR remains the Winner and the purse is now duly payable to Melnyk.

Melnyk, was at the time severely embarrassed and hurt by the considerable harm to his reputation, which he suffered as a result of the decision of the Turf Club.

He considers that the decision of the High Court vindicates his position that the hearing by the Stewards of the Turf Club was “unfair“. The principle involved in this case and the vindication of Mr Melnyk‘s reputation was always the issue for Mr Melnyk. It was never about securing the purse.

Melnyk stated “This action was never about money but principal. I have always been a great supporter of horse racing and sport in Barbados and I now intend to distribute the purse to various charities supporting youth and sporting foundations.”
